1. Acceptance of these Terms

By downloading, accessing, or using fmRadio, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app. If you use fmRadio on behalf of an organization, you confirm that you have authority to accept these Terms for that organization.

These Terms form an agreement between you and xType ("xType", "we", "us", or "our"), the developer and publisher of fmRadio.

2. The fmRadio service

fmRadio helps users discover and play publicly available internet radio streams. Depending on the app version and device, it may also provide favorites, station search, a home-screen widget, media controls, temporary timeshift, stream recording, optional sound processing, and optional Google Drive favorite synchronization.

Station listings may be supplied by public directories. Audio is delivered by independent radio stations or hosting providers. xType does not own, operate, select, or endorse every listed station and does not control the availability, accuracy, legality, quality, advertising, or content of third-party streams.

3. Eligibility and device requirements

You must be legally able to enter into these Terms. If you are below the age at which you may enter into a binding agreement where you live, a parent or legal guardian must approve your use.

You need a compatible Android device and internet connection for live radio. Network charges, roaming fees, device costs, and any Google account or storage arrangements are your responsibility.

4. Optional Google Drive favorite synchronization

Favorite Sync is optional. If you activate it, fmRadio requests authorization to access only its private application-data area in your Google Drive. The synchronized data can include favorite-station identifiers, names, stream addresses, country information, and timestamps or deletion markers needed to merge changes between devices.

• fmRadio does not receive permission through this feature to browse your other Drive files.
• Local favorites remain usable without a network connection.
• Synchronization can be delayed or fail because of network conditions, account settings, storage limits, Google service availability, clock differences, or changes made simultaneously on multiple devices.
• You can select Delete cloud favorites to permanently delete fmRadio's synchronized favorites file, revoke authorization, and disconnect Favorite Sync while keeping local favorites. Disconnecting without deletion stops future synchronization but does not delete an existing fmRadio application-data file.
• You can manage connected-app access and hidden application data through your Google account or Google Drive settings.

Your use of Google services is also governed by the terms and policies that apply to your Google account. Details about how fmRadio handles Google user data appear in our Privacy Policy.

5. Radio content and recordings

Radio programs, music, station names, logos, metadata, advertisements, and streams may be protected by copyright, trademark, broadcasting, contract, or other rights belonging to stations and third parties.

fmRadio's recording feature saves the selected station's internet audio stream on your device; it does not use the microphone for radio recording. Recording, retaining, exporting, sharing, rebroadcasting, or commercially using a stream may be restricted where you live or by a station's terms. You are responsible for obtaining any required permission and using recordings only as allowed by applicable law.

xType does not grant you rights in third-party radio content and is not responsible for your use of a recording or stream.

6. Advertising and privacy

fmRadio may display advertising provided by Google AdMob or other disclosed providers. Advertising helps fund the app. Depending on your region, device, consent choices, and provider settings, ads may be personalized, non-personalized, limited, or used only for technical delivery.

7. Acceptable use

You agree not to:

• use fmRadio in violation of applicable law or third-party rights;
• interfere with, overload, damage, probe, or bypass the security of the app or a connected service;
• use automated methods to extract station-directory data or abuse third-party APIs;
• misrepresent your relationship with xType, fmRadio, Google, a station, or another provider;
• reverse engineer, modify, or redistribute fmRadio except where applicable law expressly permits it;
• use radio content or recordings in a way that infringes copyright or other rights.

8. Ownership

Except for third-party content and open-source components, fmRadio's software, design, branding, and original materials belong to xType or its licensors and are protected by applicable intellectual-property laws. These Terms give you a personal, limited, revocable, non-exclusive, and non-transferable right to use the app on compatible devices for its intended purpose.

Third-party software included in fmRadio remains subject to its applicable open-source or commercial license.

9. Third-party services

fmRadio relies on services that xType does not control, including Google services, Radio Browser, GitHub-hosted resources, Android system services, radio stations, stream hosts, network providers, and email or file-sharing apps you choose to use. Their own terms and privacy policies apply to their services.

A link, listing, or connection does not mean that xType endorses the third party. Third-party services may change, restrict access, require payment, become unavailable, or provide inaccurate or inappropriate material without notice to xType.

10. Updates, availability, and changes

We may update, add, remove, suspend, or discontinue features to improve fmRadio, address security or legal requirements, accommodate platform changes, or respond to third-party service changes. Some updates may be required for continued use.

We do not promise that every station, stream, directory, recording, synchronization operation, or feature will always be available or error-free. Internet streams frequently move, reject connections, change formats, or stop operating.

11. Disclaimers

To the maximum extent permitted by law, fmRadio is provided on an "as is" and "as available" basis. xType disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy, and freedom from errors or harmful components.

We do not warrant third-party streams, station information, advertisements, cloud services, or content. You should keep independent copies of favorites or recordings that are important to you and should not rely on fmRadio as the sole storage location.

12. Limitation of liability

To the maximum extent permitted by law, xType will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, favorites, recordings, profits, goodwill, business opportunity, or access arising from fmRadio or a third-party service.

Where liability cannot be excluded, xType's liability will be limited to the greater of the amount you paid directly to xType for fmRadio during the twelve months before the event giving rise to the claim or ten euros (€10), unless applicable law requires a different remedy or limit.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence where applicable.

13. Suspension and termination

You may stop using fmRadio at any time and uninstall it. You may separately disconnect Google Drive synchronization from the app.

We may suspend access to a feature or discontinue the service when reasonably necessary for security, legal compliance, misuse prevention, or service operation. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and governing law—will continue to apply.

14. Changes to these Terms

We may update these Terms when fmRadio, applicable law, or third-party requirements change. The revised Terms will be posted at this URL with a new effective date. Where required, we will provide additional notice or request renewed agreement. Continued use after the revised Terms take effect means you accept them to the extent permitted by law.

15. Governing law and disputes

These Terms are governed by the laws of Greece, without regard to conflict-of-law principles. Courts with jurisdiction in Greece will have jurisdiction over disputes, except where mandatory consumer law gives you the right to bring a claim in another court or under another law.

If you are a consumer in the European Economic Area or another jurisdiction with mandatory consumer protections, you retain all rights that cannot be waived by contract. Before starting formal proceedings, you and xType are encouraged to contact each other and attempt to resolve the issue informally.

16. General terms

If any provision is held invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; xType may transfer them as part of a merger, reorganization, asset transfer, or change in app ownership, subject to applicable law.

These Terms and the referenced Privacy Policy are the entire agreement between you and xType about fmRadio, except for any additional terms that must apply by law or are presented for a specific feature.
